PG&E Pleads Not Guilty! #metoo

SAN BRUNO -- PG&E pleaded not guilty Monday to a new federal criminal indictment on felony charges linked to a fatal 2010 natural gas pipeline explosion here, and hours later, San Bruno officials requested that the state Public Utilities Commission preserve computer drives and digital data that could shed light on ties between the PUC and the utility it oversees.
The city of San Bruno, where eight people were killed in the pipeline explosion, says it's concerned that key emails, texts and other electronic documents, as well as paper documents, voice mails and handwritten notes could vanish amid a current effort by the PUC to swap out hard drives on its computers.

San Francisco-based PG&E is charged with 28 federal criminal counts, including obstruction of justice for allegedly impeding an investigation into the explosion and violations of the pipeline safety act that led to the explosion.

"Not guilty to all counts," Steven Bauer, an attorney for PG&E with law firm Latham & Watkins, said at the brief proceeding Monday before a federal magistrate at the U.S. District Court in San Francisco. Individual employees of PG&E have not been charged in the case, and PG&E executives did not appear at the hearing.

Assistant U.S. Attorney Hallie Hoffman, who appeared for the federal prosecution in the proceeding, said the utility faces a fine of up to $1.13 billion if convicted.

Following the hearing, San Bruno City Manager Connie Jackson requested that federal prosecutors press for creation of a California pipeline safety trust to help improve natural gas pipes statewide, and to establish an independent monitor to oversee PG&E and the state Public Utilities Commission.

"PG&E has refused to step up and take full responsibility for the explosion," said Jackson, who expressed the city's support for the government prosecution.
San Bruno officials, in a letter to PUC Executive Director Paul Clanon, said it is essential that all electronic equipment, data and documents related to three ongoing investigations into the explosion be preserved and available for public inspection.

"Any failure to assure the preservation and protection of all paper and electronic documents related to these proceedings could form the basis of criminal or civil liability for destroying evidence or spoliation of evidence," Jackson wrote in the letter.
One of the federal criminal charges alleges that PG&E deliberately obstructed an investigation of the explosion by the National Transportation Safety Board.
Federal prosecutors also have charged PG&E with 27 alleged violations of pipeline safety rules.
"Based on all of the evidence we have seen to date and our review of the new indictment, we still do not believe that PG&E employees intentionally violated the federal Pipeline Safety Act," PG&E spokesman Greg Snapper said after the hearing. "Even where mistakes were made, employees were acting in good faith."
Separately, San Bruno pointed out that a series of emails between officials with the PUC and PG&E show a cozy relationship between the two organizations.
The latest suggestions of an improper relationship are linked to a cancelled symposium on gas safety sponsored by the state government. PG&E worked closely with the PUC on the symposium, which was canceled after San Bruno officials brought the meeting to light, calling it a "dog-and-pony show" aimed at presenting PG&E in a favorable light.
"This is appalling," Jackson said. "It was our protests that caused the cancellation of that symposium."
The symposium flap is one of numerous instances that suggest close ties between the PUC and PG&E. In some of the emails, PUC President Michael Peevey offered public relations advice to PG&E.
The emails involving the PUC have prompted numerous critics to demand Peevey's ouster.
But in a meeting last week with the editorial board of this newspaper, Gov. Jerry Brown expressed support for Peevey, describing him as "a very effective leader; he gets things done."

San Bruno says that the PUC, under Peevey's leadership, has fostered close ties with PG&E that are improper. "PG&E is pulling the strings at the PUC," Jackson said.

Abstract: In this article I will correlate why my 2004 Truck fire will lead to solving all the fires in Contra Costa County.  Several of these fires occurred in Rossmoor that will lead from the Limo Fire on Skycrest to the Limo Fire on the San Mateo Bridge which could lead to the deadly FedEx Truck Fire where students heading northbound Interstate 5 in preparation of attending college.

I've developed a highly plausible theory on the uncomfortable theory the real story is this was Domestic Terrorism for legal profit which is theoretically linked to my 200 Arson case and how Law Enforcement in Contra Costa County have covered up decades of arson cases as fires.

From there I will argue that the sum of these events connect to the PG&E San Bruno Explosion and the Walnut Creek Explosions.  The only two North American Gas Line Explosions that resulted in significant deaths occurred in the same geographic region but worse had the Municipal Pooling Authority, EBMUD and Contra Costa Law Enforcement had done their job then we'd know the truth about the The Dead Contra Costa Witness Program or that perhaps my efforts connected to my 2004 Truck Fire are being derailed to cover up the obvious that it was attempted murder.

SAN FRANCISCO, Calif. - On April 1, 2014, a federal grand jury for the Northern District of California returned an indictment charging Pacific Gas and Electric Company ("PG&E") with multiple violations of the Natural Gas Pipeline Safety Act of 1968 ("PSA"), announced U.S. Attorney Melinda Haag, California Attorney General Kamala D. Harris, San Mateo County District Attorney Stephen M. Wagstaffe, U.S. Department of Transportation Office of Inspector General Special Agent in Charge William Swallow, and FBI Special Agent in Charge David J. Johnson. PSA violations were uncovered in the course of an investigation initiated after the fatal San Bruno natural gas pipeline explosion in 2010.


The indictment alleges that PG&E knowingly and willfully violated the PSA and its regulations between 2003 and 2010. According to the indictment, the charges stem from PG&E's record keeping and pipeline "integrity management" practices. The indictment alleges that PG&E failed to address recordkeeping deficiencies concerning its larger natural gas pipelines knowing that their records were inaccurate or incomplete.


The indictment also alleges that PG&E failed to identify threats to its larger natural gas pipelines and that PG&E did not take appropriate actions to investigate the seriousness of threats to pipelines when they were identified. In addition, the indictment alleges that PG&E failed to adequately reprioritize and assess threatened pipelines after the pipelines were over pressurized as required by the PSA and its regulations.


"The citizens of Northern California deserve to have their utility providers put the safety of the community first," said U.S. Attorney Haag. "Today's indictment of PG&E for violating the minimum safety standards established by the Natural Gas Pipeline Safety Act reflects the company's failure to follow that very basic principle. This investigation is the result of strong collaboration among federal, state, and local law enforcement authorities, the California Attorney General's Office, and the San Mateo County District Attorney's Office. I look forward to continuing to work closely with these partners in our efforts to hold PG&E accountable for their disregard for the safety of our community."


"Today's indictment is an important step in providing justice for the individuals, families and community devastated by the 2010 pipeline explosion and fire in San Bruno," said California Attorney General Kamala D. Harris. "As alleged in the indictment, PG&E knowingly and willfully failed to identify and evaluate threats to its transmission pipelines, including Line 132 underneath much of San Bruno. When allegedly faced with evidence of transmission line problems, PG&E knowingly and willfully chose not to assess and remediate the problems. My office will continue our work with local and federal partners in prosecuting this matter in federal court and holding PG&E accountable for its alleged conduct."


"The indictment returned by the Grand Jury is an important step in holding PG&E criminally responsible for their willful misconduct," said San Mateo County District Attorney Stephen M. Wagstaffe. "The San Bruno Police Department and my office will continue to support and work closely with the offices of the United States Attorney and the California Attorney General to bring PG&E to justice."


"Pipeline safety is a top priority for the Department of Transportation and the Office of Inspector General," said William Swallow, DOT OIG regional Special Agent-in-Charge. "The lasting impacts among families and the community stemming from the tragic explosion in San Bruno remind us of why it is important to exercise vigorous management and oversight. The DOT OIG will continue to work with our law enforcement and prosecutorial colleagues to ensure that parties responsible for protecting public health and safety are held to the highest standards."


"The Federal Pipeline Safety Act is designed to guard against risks to life or property in the course of distributing goods and services to entrusting consumers," said FBI Special Agent in Charge David J. Johnson of the San Francisco Field Office. "This office has the responsibility not only to uphold and enforce the criminal laws of the United States but also to do everything we can to protect the public. The charges alleged in this indictment should be symbolic of the FBI's commitment to serving justice no matter how long it takes."


PG&E is charged with 12 separate violations of the PSA. The maximum statutory penalty for each count for a corporation is $500,000 or a fine based on the gain the corporation made as a result of the violation or the loss caused to victims.


An indictment merely alleges that crimes have been committed, and the defendant is presumed innocent until proven guilty beyond a reasonable doubt.


The prosecution is the result of a three-year investigation conducted by the U.S. Attorney's Office for the Northern District of California, the California Attorney General's Office, the San Mateo County District Attorney's Office, the United States Department of Transportation Office of Inspector General, the FBI, the Pipeline and Hazardous Material Safety Administration, and the city of San Bruno Police Department.

SAN FRANCISCO - A federal grand jury for the Northern District of California returned a superseding indictment charging Pacific Gas and Electric Company (PG&E) with obstruction of the investigation of the National Transportation Safety Board ("NTSB"), as well as additional violations of the Natural Gas Pipeline Safety Act of 1968 (PSA), announced U.S. Attorney Melinda Haag, California Attorney General Kamala D. Harris, San Mateo County District Attorney Stephen M. Wagstaffe, U.S. Department of Transportation Office of Inspector General Special Agent in Charge William Swallow, and FBI Special Agent in Charge David J. Johnson.




The superseding indictment alleges that PG&E obstructed the NTSB's investigation that began immediately after the deadly San Bruno explosion. According to the superseding indictment, during the course of the NTSB's investigation, PG&E provided a version of a policy outlining the way in which PG&E addressed manufacturing threats on its pipelines. PG&E later withdrew that policy claiming it was produced in error, and was an unapproved draft. In fact, PG&E was operating under the so-called unapproved draft from 2009 through April 5, 2011. The consequence of this practice was that PG&E did not prioritize as high-risk, and properly assess, many of its oldest natural gas pipelines, which ran through urban and residential areas.

Additionally, the superseding indictment charges PG&E with 27 counts of knowingly and willfully violating the PSA. These charges stem from PG&E's record keeping and pipeline "integrity management" practices. The superseding indictment alleges that PG&E failed to address recordkeeping deficiencies concerning its larger natural gas pipelines knowing that their records were inaccurate or incomplete. The superseding indictment also alleges that PG&E failed to identify threats to its larger natural gas pipelines and that PG&E did not take appropriate actions to investigate the seriousness of threats to pipelines when they were identified. Finally, the superseding indictment alleges that PG&E failed to adequately reprioritize and assess threatened pipelines after the pipelines were over pressurized as required by the PSA and its regulations.

PG&E is charged with one count of obstruction of an agency proceeding in violation of 18 U.S.C. §1505, and 27 separate counts of violations of the PSA. The maximum statutory penalty for each count is a $500,000 fine or a fine based on the twice the gross gain PG&E made as a result of the violations, or twice the losses suffered by the victims. The superseding indictment alleges that PG&E derived gross gains of $281 million, and victims suffered losses of approximately $565 million. PG&E is next scheduled to appear on August 18, 2014 before the Honorable Thelton E. Henderson, United States District Judge.




Kim A. Berger and Hallie M. Hoffman are the Assistant U.S. Attorneys who are prosecuting the case, with the assistance of Alycee Lane and Pat Mahoney, along with Deputy Attorneys General Brett Morris and Deborah Halberstadt from the California Attorney General's Office. The prosecution is the result of an investigation conducted by the San Mateo County District Attorney's Office, the United States Department of Transportation Office of Inspector General, the FBI, the Pipeline and Hazardous Material Safety Administration, and the city of San Bruno Police Department.

Please note, an indictment contains only allegations and, as with all defendants, PG&E must be presumed innocent unless and until proven guilty.
