Walnut Creek CA -- A clear reality of my situation is how cases are handled around Contra Costa County. My 2004 arson was witnessed by Danville Police Officer and the Mechanic at Gregg's Muffler in Lafayette CA.


It's been ten years since the 680 arson yet in 2014 while walking between Walnut Creek Police Department and my campsite I'm dodging SL 550 Mercedes while several Walnut Creek Police Officers are positioned to watch me get creamed where Mt. Diablo Blvd meets Broadway.  The timing is relevant as on June 26th 2014 numerous claims were filed against with the City Of Walnut Creek but within a week a car tried to run me over again.
Nearly all Contra Costa County Cities use the same risk management services provided by the Municipal Pooling Authority (MPA) under CSAC using the Joint Powers Authority (JPA).  I've filed many claims on my own because the Contra Costa Bar Association controls the intake referrals and I was summarily told I can't get a referral through them.
Many thanks while the Walnut Creek City Attorney lofts around town persons unknown have been trying to kill me and they tried to killing my sons in 2005.

It's happened to me in Pittsburg, Walnut Creek and Danville where I've attempted to litigate.  I sued Danville Building Inspector Gary Vinson Collins in 2006 but my Attorney Sage Sehapi has the shit kicked out of him a during a Walnut Creek Basketball game on Oak Road.

The WCPD true to form refused to arrest the suspect sending Mr. Sehapi in circles who being an attorney wanted to sue.   The officers probably obstructed justice by hiding this case from the District Attorney just like Danville Police did with the Bennett/Collins assault but now ten years later we've got murders, arson coupled with the fact that the PG&E Indictment now contains obstruction of justice charges. 


Witness Termination

After the Lafayette Police refused to investigate this blogger's July 20th 2011 Hit & Run/Attempted Murder I turned to State Senator Mark Desaulnier who called the Legislative Security Services Threat Assessment Unit (TAU) who interviewed me in Aug 2011 but sadly since then many have died with no end in site. 
I told this unit that I suspect Councilman MIke Shimansky Spinal Meningitis death was not natural.  This information was passed on in Sept 2011 but since then Councilman Bell and Tax Collector Pollacek each succumbed to meningitis but consider the argument of violations of the Geneva Convention. 

On Nov 9th 2004 a Kinder Morgan Gas Pipeline Explodes but few noticed that several persons near this pipeline disaster died. 


The Who Gives A Shit County  

For several decades I've been a lock step battle with the rich and powerful.  I didn't realize how much was being put into trying to take me out until the car zoomed by me on September 28th 2013 but the response from the Walnut Creek Police was pathetic.
I've made numerous attempts to get an investigation started over at least five Hit and Run Incidents since 2004 and the Unionized Agencies have a clear and powerful agenda.
The persons who witnessed my near miss were also recorded by Safeway Cameras where they used their personalized Safeway Stalking Card managed in the Philippines where your personal data is splayed out around the globe.

How many lawyers in gorilla suits does it take to tackle poverty? It might sound like joke, but to the 31 Bay Area law firms competing in United Way's Koko Challenge this year, fighting poverty is something they all take very seriously.

Every year, the legal community comes together to raise money to fight poverty. Competition is fierce, and top winners receive stuffed gorillas as a prize. Law firms have been known to station their gorillas proudly in their lobbies, symbolizing their dedication to the community.
On September 22, we kicked-off the 24th annual Koko Challenge, Last year, 21 participating firms raised $1.5 million. With 10 new firms joining the Challenge this year, we're excited to see the legal community once again raise the bar for philanthropy in the Bay Area.

The theme of this year's challenge is "Class action against poverty," to align with United Way's community effort to cut in half the number of local families who live in poverty by the year 2020.

Gap, Inc. General Counsel Michelle Banks, chair of this year's Koko Cabinet, announced this year's goal to raise $1.8 million, with $700,000 directed to United Way.
The Fremont Group General Counsel Rick Kopf chimed in, urging everyone to increase their gifts by 20% and direct it to United Way programs: SparkPoint, Community Schools, MatchBridge, 211 and Earn It! Keep It! Save It! This collective increase would raise an additional $300,000 for United Way, and enable us to continue to operate and expand our poverty fighting programs.

The spirit and enthusiasm of Shook, Hardy and Bacon LLP Partner Kevin Haroff was hard to match as he had already purchased his own gorilla suit. To help raise spirits - as well as funds - during this year's Challenge, he offered to wear the gorilla suit to any event hosted by the 10 new participating firms.

Many thanks to Shook, Hardy and Bacon LLP, winner of last year's Baby Koko award and host of our kick-off event. And, thank you to the Koko Koko Cabinet, a volunteer committee that oversees the Challenge (listed below). The Challenge would not be possible without your support and enthusiasm.

The Cherry Letter Strikes Again

A federal grand jury is probing potentially illegal ties between Pacific Gas and Electric Co. executives and regulators with the California Public Utilities Commission, The Chronicle has learned.
The investigation is looking into "PG&E’s relationship" with state regulatory officials, according to a May 15 letter to the utility from federal prosecutors.

The probe is separate from the federal court case charging PG&E with violating pipeline safety laws and obstructing justice in connection with the 2010 pipeline explosion in San Bruno that killed eight people. Prosecutors in that case are seeking more than $1 billion in fines from the company, but have not charged individual executives.

The latest grand jury investigation was opened after last year’s disclosure of e-mails between PG&E and the state utilities commission, which prompted probes by both state and federal prosecutors. Some of the e-mails showed a PG&E executive lobbying commissioners and their staffs for a preferred judge to oversee a $1.3 billion rate case. Others indicated that PG&E thought then-commission President Michael Peevey was dangling favorable state treatment in exchange for the utility’s backing for his pet fundraising and political causes.

In the letter disclosing the grand jury investigation, Assistant U.S. Attorneys Kim Berger and Hallie Hoffman told PG&E’s lawyers that they plan to use some of the evidence from the probe in the prosecution of the San Bruno case against the company. They did not specify what that might be.

The letter came in response to a PG&E request that federal prosecutors turn over San Bruno-related evidence and notes gathered by state regulators with the utilities commission.
Officials with the U.S. attorney’s office in San Francisco declined to comment on the letter, and representatives of the utilities commission did not immediately respond to a request for comment.
A PG&E spokesman, Greg Snapper, said in a statement: "We’ve publicly reported that state and federal attorneys have begun investigations in connection with these communications. We’re going to keep cooperating with officials as the process moves forward."

The state attorney general’s office opened its own investigation last fall. It has not filed criminal charges.
As part of the probe, state agents served search warrants on the commission’s San Francisco headquarters, at Peevey’s home in Southern California and at the Orinda home of a former PG&E vice president, Brian Cherry. It was Cherry who sent many of the PG&E e-mails that prompted the state and federal probes.
One focus of the state investigation is an apparently secret deal that Peevey outlined in 2013 to an executive of the utility he used to head, Southern California Edison, regarding costs related to the shutdown of the troubled San Onofre nuclear power plant.

Notes that investigators seized from Peevey’s home showed that the deal included provisions for directing utility money into research to reduce greenhouse gas emissions.
When the final deal had no such funding, Peevey pressured Edison to put up money, according to a sworn statement by one company executive. Peevey separately indicated to officials at UCLA that they could be in line for a greenhouse-gas funding windfall, e-mails between them show.

When the utility apparently did not budge, Commissioner Mike Florio — who joined Peevey during meetings with Edison — proposed in late 2014 that the commission set aside greenhouse research money from San Onofre for the University of California system. The same month Florio proposed that funding, Peevey landed a seat on an advisory panel at UCLA’s Luskin Center for Innovation.
Additional e-mails involving back-channel communications between utilities and the state commission continue to trickle out. The most recent came Thursday, when PG&E released an e-mail that Cherry sent in March 2014 to PG&E colleagues recounting a conversation he had with Florio involving a regulatory matter.

Cherry said he had asked Florio whether PG&E should seek to have an administrative law judge, Steve Roscow, recused from a case, which records show concerned PG&E’s efforts to obtain customer money to conduct seismic studies at the Diablo Canyon nuclear power plant. Florio was the commission member assigned to oversee the matter.

"I spoke with Florio about Roscow," Cherry wrote. "Mike believes there is no need to bump Steve if he is the assigned commissioner. He understands Steve’s bias."
Florio figured in another instance of apparent PG&E judge-shopping, telling Cherry in a January 2014 e-mail that he would "do what I can on this end" to "bump" a judge PG&E didn’t want on the $1.3 billion rate-setting case. Florio, an attorney for a utility customer-advocate group before Gov. Jerry Brown appointed him to the commission in 2011, later explained that he "didn't know the rules" against back-channel communications between regulators and utilities and that he had "screwed up."
Florio did not respond to a phone call seeking comment Thursday about the latest e-mail.

Your PR campaign says one thing but your legal defense connects to events connected to Howard Golub, his brother the Judge and officers now in Federal Prison.

There is a strong connection to why I was hired to work at PG&E why I ended up with your documents, how these documents now likely involved the Metcalf attack and Fresno Explosion but after researching for three years have concluded there are incidents and your company was targeted by the same people that targeted me. 

I have lost everything more than once over 30 years and most of the time it was connected to police officers connected to Joel Golub.  I have lived the can't win story.

The July 2011 hit and run was attempted murder of your subcontractor which is me.  They tried to kill my sons in 2005 and repeated that on my way home from Modesto operations.

We/they have suffered the brunt of your terrorism event.

You can thank the Golubs next time you chat but they are one leg or more legs of why your pipeline exploded.  I am just a programer that was interested in developing software for a good cause.  My PG&E story is an extension of other events and PG&E was setup by friends of Golubs.

For many years I've complained to PG&E about unpaid invoices with PG&E MBE Vendor Ravenel Enterprises, a firm that retained my software development services specifically for the Hyrdo Test Project.

The project ended with my car being totaled by parties suspected connected to other Federal Grand Jury Investigations where police officers, attorneys and others are in Federal Prison.

The events I've endured were documented in a letter to Brian Cherry, CPUC, FBI and US Attorney's Offices.


Boots Not Suits

You can explain to the SEC how I was attached to PG&E, how my car was totaled, why I was hired to work for PG&E with bench warrants, how the Chief of Police Of Lafayette who definitely knows the Golub's via the courtroom, how all the parties know former officers now in Federal Prison but how each Golub has ties to persons with criminal records e.g. Michael Milken.

I'd like to know who killed my family in Springville, how my friend's 2005 Murder Suicide ties in the Walnut Creek Kinder Morgan Explosion where deaths of witnesses were discovered via my research.

The Brian Cherry Letter sent just prior Federal Grand Jury superseding indictment handed down on July 29th, 2015 where documents posted this blog match dates posted to this blog.

My allegations should appear in the SEC reports, be forwarded to NTSB, NRC, FERC.gov, FBI, CPUC and DOT in the exact same manner that your press releases state of renewed transparency

Who is DOT OIG's Whistleblower Protection Ombudsman?

The Inspector General has designated Ronald C. Engler as the Office of Inspector General’s (OIG) Whistleblower Protection Ombudsman, tasked with educating U.S. Department of Transportation (DOT) employees about prohibitions against retaliating against Federal whistleblowers and their specific rights and remedies. However, the Ombudsman cannot act as a legal representative, agent, or advocate for DOT employees. Mr. Engler can be reached at: 202-366-4189.

What is Whistleblowers Retaliation?

Whistleblower retaliation is an adverse action in response to a protected disclosure of information.  Retaliation includes almost any personnel action, failure to take a personnel action, or threat to take or fail to take a personnel action, which adversely affects the whistleblower, such as:
  • A non-promotion
  • A disciplinary action
  • A detail, transfer or reassignment
  • An unfavorable performance evaluation
  • A decision concerning pay, benefits or awards
  • A significant change in duties, responsibilities or working conditions

Who is Protected from Whistleblower Retaliation?

  • DOT Employees
  • Employees of DOT contractors
  • Employees of DOT subcontractors and grantees for contracts that were entered into after July 1, 2013 and some contracts that were modified after July 1, 2013
  • Employees of American Recovery and Reinvestment Act (ARRA) fund recipients, including State and local governments, contractors, subcontractors, grantees or professional membership organizations acting in the interest of recovery fund recipients

What Types of Discolsures are Protected?

In order for your disclosure to be protected, you must have a reasonable, good faith belief that the allegations you are disclosing are truthful. There are five types of protected disclosures:
  • A violation of law, rule, or regulation
  • Gross mismanagement
  • Gross waste of funds
  • A substantial and specific danger to public health or safety
  • An abuse of authority

Where Can You Report a Complaint of Whistleblower Retaliation?

OIG Hotline:
If you are a DOT employee, an employee of a recipient of Recovery Act funds, an employee of a DOT contractor or an employee of a DOT subcontractor, or grantee on a contract entered into or subject to a major modification after July 1, 2013 you may file a complaint with the OIG Hotline. (For more information on special protections for DOT and non-DOT employee whistleblowers involving ARRA funds click here.)

Office of Special Counsel (OSC):
If you are a Federal employee, including a DOT employee, and wish to report a prohibited personnel practice, including whistleblower retaliation, you may wish to file a complaint directly with the OSC. The OSC is an independent federal investigative and prosecutorial agency with the responsibility to receive, investigate, and prosecute allegations of whistleblower retaliation. Unlike the OIG, the OSC has  authority to seek corrective action from DOT by negotiating with the DOT agency involved or, if that is unsuccessful, by filing a complaint with the Merit Systems Protection Board (MSPB) to enforce corrective action for the whistleblower and initiate disciplinary action against the individual responsible for the retaliation. Corrective action might include ordering a promotion, cancelling a disciplinary action, payment of back pay, compensatory damages, and attorney’s fees. U.S. Office of Special Counsel Certification

The Office of Inspector General's compliance with 5 U.S.C. 2302(c) obligations to inform DOT's workforce of their rights and remedies under the prohibited personnel practice and whistleblower protection provisions of chapters 12 and 23 of Title 5 has been certified by the U.S. Office of Special Counsel. This certification is effective through December 2017.

Secretary's Memorandum to All DOT Employees

On January 23, 2015, Secretary of Transportation Anthony Foxx highlighted his support for ongoing cooperation with the Office Of Inspector General through a Department-wide memorandum. In his memorandum, the Secretary reminded DOT employees that reprisals against employees who provide information or report allegations of waste, fraud, and abuse to OIG are against the law and Departmental policy.

UPDATE: Officials at Pacific Gas & Electric refused to say Nov. 7 whether or not the giant utility has also been served with a search warrant by the State Attorney General's office. Instead, Keith Stephens,PG&E's senior director of business ops and field communications, confirmed only that the company "is cooperating with law enforcement officials." Pressed for a direct response to the question, Stephens repeated the same answer.
The California State Attorney General's office served a search warrant and seized records from the California Public Utilities Commission's San Francisco headquarters Thursday as part of an investigation of potentially illegal "back-channel" email communications between CPUC officials and Pacific Gas & Electric, according to aSan Francisco Chronicle report.
Officials at the CPUC and State Attorney General Kamala Harris' office weren't immediately available for comment early Friday morning. A CPUC spokesman wouldn't confirm or deny the published report, but said at about 9:45 a.m. that the commission might have a public statement about the matter "in about an hour." That was several hours ago.
Nick Pacilio, a spokesman for the State Attorney General's office, told me early Friday afternoon that Harris' office is not commenting on the search warrant situation and, in fact, hasn't "commented on whether or not we're investigating" the CPUC.
The Chronicle account, by Jaxon Van Derbekencites anonymous sources who said the search "netted documents and other data sought under a sealed warrant."
State and federal authorities are investigating the case, which involves so-called ex parte communications between CPUC President Michael Peevey, board member Mike Florio, senior PG&E officials and possibly others. At issue, among other sensitive topics, is an attempt by PG&E officials to have an administrative law judge seen as less likely to rule in the giant utility's favor in a huge rate-setting case replaced with one more amenable to PG&E's arguments.
As noted in the Chronicle article, the state Attorney General's office told the CPUC on Sept. 19 it needed to "preserve" any emails and other documents relevant to the case.
PG&E fired thee executives in September after some of the emails were made public, following a demand by the city of San Bruno. The rate case involves more than $1 billion in payments PG&E is seeking from its customers to help pay for gas pipeline improvements in the wake of the September 2010 gas-line explosion and fire that devastated San Bruno's Crestmoor neighborhood, killed eight people and damaged or destroyed hundreds of homes.
Peevey announced in mid-October he wouldn't seek reappointment as the commission's president. His term expires at year-end. Florio recused himself, also in mid-October, from further involvement in the rate-setting case.
The city of San Bruno is trying to compel the CPUC to release thousands of emails that may shed light on secret communications on the rate case and related issues, and said earlier this week that the commission is advocating changes that "could make it harder to obtain public records" in this case and others.
City officials initially filed a public records act lawsuit that forced the CPUC to make 7,000 pages of documents public, including some that San Bruno officials say "exposed shocking, illegal emails" between commission and PG&E officials.
Tara Kaushik, a San Francisco-based partner at the Holland & Knight law firm who frequently works with the commission, predicted that one way or the other the CPUC is going to make significant changes in how it communicates with stakeholders, meaning companies and organizations it regulates or works with.
"We're going to see big changes in the industry going forward," she said, referring to the type of communications that have put the agency in potential legal hot water.
